Terms of service

Your mandatory rights

Nothing in these Terms excludes, restricts or modifies a right, remedy, warranty or liability that cannot lawfully be excluded, restricted or modified. If you are a consumer, you retain the mandatory protections that apply to your purchase. These protections take priority over any conflicting provision of these Terms or another store policy.

This website is operated by Finitra LLC, trading as Dimo Chair. Throughout the site, the terms “we”, “us” and “our” refer to Finitra LLC. Dimo Chair offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

New features or tools added to this website are subject to these Terms. Changes to these Terms are addressed in section 19.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

1. Use of the online store

You must have the legal capacity required to place an order. You must not use this website or our products for an unlawful purpose, infringe another person's rights, or transmit malicious code through the website.

If you breach these Terms, we may take lawful and proportionate action to protect the website and its users. This does not remove rights or obligations relating to an existing order.

2. General conditions

We may refuse a new order or restrict access to this website where permitted by applicable law. Any action affecting an existing order remains subject to the agreed order terms, applicable law and any required notice or refund.

You must not reproduce, sell or commercially exploit the website's content or services without permission, except where applicable law permits you to do so.

Personal information is handled as described in our Privacy Policy. Do not submit payment card details through ordinary email or a contact form.

3. Website information

General editorial and historical material on this website is provided for information. It may not describe the current availability or condition of a particular item.

Product descriptions, disclosed condition, prices and other information forming part of an order remain subject to applicable law and the agreed order terms. This section does not disclaim responsibility for information that we are legally required to provide or for goods that do not match their description.

4. Changes to the website and prices

We may change the website, available products and advertised prices for future orders. A later website or price change does not by itself change an order already accepted.

Changes affecting an existing order are subject to applicable law and any agreement required from you.

5. Products and their presentation

Dimo Chair offers newly made standard collection furniture, vintage furniture and custom projects. Read the description and any condition or specification information for the item concerned.

Screen settings can affect how colours appear. This does not remove our responsibility for the accuracy of product descriptions or any mandatory rights concerning the goods supplied.

We may change the range, availability and quantities offered for future orders, subject to applicable law. These changes do not by themselves change accepted orders.

Cancellation and returns are addressed in our Returns and refunds policy. Vintage status, manufacture after order or selection of a standard finish does not automatically exclude statutory rights.

6. Order and account information

Provide current and accurate contact, billing and delivery information so that we can communicate with you about an order and arrange its fulfilment. Keep relevant account details up to date.

We may decline a new order where permitted by law. If we propose to change or cancel an existing order, we will notify you and provide any refund or other remedy required by applicable law and the agreed order terms. This section does not give us an unrestricted right to cancel an accepted order.

For cancellation and return information, see our Returns and refunds policy.

7. Optional third-party tools

If this website offers an optional tool supplied by a third party, review any terms and privacy information that apply to that tool before using it.

Our responsibility for tools made available through this website is determined by applicable law and any applicable agreement. This section does not exclude responsibility that cannot lawfully be excluded.

8. Third-party links

This website may link to independently operated websites. Their own terms and privacy notices apply to your use of those websites. Review them before providing information or making a separate purchase.

A link does not by itself mean that we endorse the linked website. Nothing in this section excludes our responsibility for our own statements or conduct where applicable law imposes that responsibility.

9. Reviews and other submissions

If you choose to submit a review or other content for public display on our website, you permit us to display that content for the purpose for which you submitted it, subject to applicable law and any rights you retain. We may remove unlawful content or content that infringes another person's rights.

You must have the rights needed to submit the content. It must not be unlawful, misleading, infringe another person's rights or contain malicious code.

Sending a private enquiry, order communication, design specification or project material does not grant us an unrestricted right to publish or commercially reuse it. Any wider permission must be separately agreed. Personal information is described in our Privacy Policy.

10. Personal information

Your submission of personal information through the store is described in our Privacy Policy.

11. Errors and corrections

We may correct errors in website information, including prices, descriptions and availability, for future orders.

If an error affects an existing order, we will contact you. Any change, cancellation or refund must follow applicable law and the agreed order terms. Correcting a website error does not by itself permit us to alter or cancel an accepted order without regard to your rights.

12. Prohibited uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

  • for any unlawful purpose
  • to solicit others to perform or participate in any unlawful acts
  • to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
  • to infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
  • to submit false or misleading information
  • to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet
  • to collect or track the personal information of others
  • to spam, phish, pharm, pretext, spider, crawl, or scrape
  • for any obscene or immoral purpose
  • to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet

Any restriction of access is subject to section 16 and applicable law.

13. Warranties and liability

Your rights concerning goods that are defective, damaged, incorrectly supplied or not as described are governed by applicable law and our Returns and refunds policy. Nothing in these Terms excludes a statutory warranty or remedy that cannot lawfully be excluded.

We do not promise that access to this website will be uninterrupted or free from technical errors. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

14. Responsibility for unlawful use

You are responsible for your unlawful use of this website and for content you submit that infringes another person's rights. Any liability arising from that conduct will be determined under applicable law. These Terms do not require a consumer to indemnify us for our own acts or omissions.

15. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

16. Ending website access

You may stop using this website at any time. We may restrict or end access for a breach of these Terms where lawful and proportionate.

Ending access does not by itself cancel an order, extinguish accrued obligations or remove a right or remedy relating to an existing order. Those matters remain subject to applicable law and the agreed order terms.

17. Agreement and interpretation

These Terms and any applicable agreed order terms govern the matters they address, subject to mandatory law. They do not remove information that forms part of the contract under applicable law or override a separately agreed order term.

A failure to enforce a right on one occasion does not by itself waive that right. Interpretation of these Terms is governed by applicable law, including any mandatory rules that protect consumers.

18. Applicable law and consumer protections

These Terms do not deprive a consumer of protections under mandatory law that applies to their purchase, or restrict access to a court or dispute resolution procedure where such access cannot lawfully be restricted.

19. Changes to these Terms

We may update these Terms by publishing a revised version on this website. Changes will apply prospectively and will not retrospectively change the terms of an order already accepted, unless permitted by law and agreed where required. We will give any notice required by applicable law.
